Terms of Service

By using Alquie App you agree to these terms. They're written in plain language — no legal degree required.

1 Who can use Alquie

Alquie is designed for teachers and educators. To create an account you must be of legal adult age according to the laws of your country.

Students who are minors access Alquie only through the unique access code their teacher provides. The teacher, by creating the account and courses, accepts these terms on behalf of their educational practice and takes responsibility for how their students use the platform.

Alquie is intended for classroom use, in-person or remote. If you use Alquie in an institutional setting, ensure you have the necessary authorization from your educational institution.

2 Your account

By creating an account on Alquie, you are responsible for:

  • Keeping your password confidential.
  • All activities that occur under your account.
  • Notifying us immediately if you suspect unauthorized access to your account.
  • Providing accurate information upon registration.

You may not create accounts in an automated manner, resell access to the platform, or share credentials among multiple unauthorized users.

3 Responsibility for student data

Teacher as data controller

When a teacher enters student names or other data into Alquie, the teacher acts as the data controller for that personal data. Alquie acts as the data processor, handling data only per the teacher's instructions and solely to deliver the educational service.

This means the teacher:

  • Is responsible for having the necessary authorizations to use student data in digital educational platforms (institutional authorization, parental consent, or whatever applies under local law).
  • Decides what data is entered (we recommend using only a first name or nickname when sufficient).
  • Is responsible for deleting student data when it's no longer needed or when a student leaves the course.

Schools with institutional packages

When a school purchases an institutional plan covering multiple teachers, the school's legal representative additionally signs a Data Processing Agreement (DPA) with Alquie. This document establishes each party's specific obligations regarding the processing of the school community's data.

The institutional DPA only applies when a school purchases a package for its entire community. Individual teachers subscribing on their own account do not need an additional DPA — these Terms of Service and the Privacy Policy are sufficient.

Guardian access to the student report

At the teacher's request and under the teacher's control, Alquie lets you invite a guardian (a parent or legal guardian) to access a read-only report for the corresponding student. This report shows information generated in the classroom: completed activities, points, progress trends, and recognitions.

  • It is the teacher who decides which student and which email address the invitation is sent to; Alquie does not contact guardians on its own.
  • The guardian can only view the report of the student or students linked to their account; they cannot edit data, content, or the roster.
  • The guardian creates their own account (email and password) to gain access and may request that their access be revoked at any time.
  • The teacher, as data controller, is the party responsible for having the authorization to share this information with the guardian.

Course collaborators (co-teacher and subject specialist)

A teacher may invite other teachers to collaborate on a course, with two possible roles: co-teacher (access to classroom operations) and subject specialist (limited access). Collaborators operate under the course plan of the owning teacher (the owner). Only the owner can manage the roster (adding and removing students, renaming, regenerating the access code, inviting guardians); collaborators can copy the access code and run the classroom mechanics. The owner is responsible for whom they invite.

Specific prices and conditions for paid plans are displayed in the platform at the time of subscription.

Payment processing

Payments for Alquie subscriptions are processed by Paddle (Paddle.com Market Ltd), an external payment provider that acts as the Merchant of Record for our products. This means that Paddle is the seller of record for your subscription —it may appear as such on your card statement— and handles billing, invoicing, applicable taxes (VAT or others depending on your country), and refunds. When you subscribe, you also accept Paddle's buyer terms. Alquie never stores your full card data; it is processed by Paddle under industry security standards (PCI-DSS).

14-day free trial

The Pro+ Plan may be offered with a 14-day free trial, subject to the following conditions:

  • A valid payment method is required to start the trial. No charge is made during the trial period.
  • During the trial you have access to all Pro+ Plan features, subject to the same AI usage limits as an active Pro+ subscription.
  • We'll send you an email reminder at least 2 days before the trial ends and the first charge is made.
  • If you do not cancel before the trial ends, the subscription automatically converts into a paid Pro+ plan and the first monthly or annual payment is charged to the registered payment method.
  • You may cancel at any time during the trial from your settings panel. If you cancel during the trial, you are not charged and you keep Pro+ access until the end of the 14 days.
  • The free trial is available once per account. It is not cumulative or transferable.

Billing and renewal

Paid subscriptions renew automatically at the end of each period (monthly or annual, per your chosen plan). You'll receive a reminder before each renewal. You can cancel your subscription at any time from your settings panel; cancellation stops future renewals and you keep access until the end of the period already paid for.

Price changes

If we change the price of a plan, the changes do not affect the period you've already paid for. We'll give you at least 30 days' notice before the new price applies to your next renewal, and you may cancel before it takes effect if you disagree.

Refund policy

If you cancel within the first 30 days of a new charge (first subscription or renewal), you may request a full refund by emailing billing@alquie.com; the refund is processed through our payment provider to the same method you paid with. After that period, no proportional refunds are issued for unused time, unless required by applicable law.

If you reside in the European Union or the EEA, you also retain the 14-day right of withdrawal granted by European law. If you choose to start using a digital service immediately, you may expressly waive that right to the extent permitted by the applicable regulations.

5 Intellectual property

Alquie's content

The Alquie platform, its code, design, characters, game mechanics, logo, and proprietary materials are owned by Alquie SpA and protected by applicable intellectual property laws. You may not copy, modify, distribute, or use these elements beyond what these terms allow. For questions about brand use, licensing, or content, contact us at legal@alquie.com.

Some visual assets on the platform — characters, illustrations, and graphic elements — were created using generative AI tools. Alquie SpA owns all such assets and assumes responsibility for their use. Under no circumstances is teacher or student data used to generate or train these systems.

Your content

Content you create in Alquie (courses, chapters, activities, questions) belongs to you. Alquie will not claim ownership over your educational content.

By using Alquie, you grant us a limited, non-exclusive, non-transferable license to store, process, and display your content solely to provide you the service. This license ends when you delete your account.

AI-assisted content

Alquie may include AI assistance tools for creating educational content. You are responsible for reviewing and validating any automatically generated content before sharing it with students. The specific Pro+ generation features are detailed in section 5bis.

5bis AI generation tools (Pro+ Plan)

The Pro+ Plan includes AI-assisted tools to generate educational content (quizzes, treasure hunts, duel arenas, narrative chapters, activities, and lab methodologies).

Sub-processor

For these features we use Google Gemini API as a sub-processor. We operate under Google's paid plan, which means Google contractually commits not to use prompts or outputs to train its models. Google's terms are available at ai.google.dev/gemini-api/terms.

Ownership of generated content

The content generated in response to your requests belongs to you. Alquie does not claim ownership over content you generate using these tools and you may edit, delete, or export it freely.

Accuracy & review

AI-generated content may contain inaccuracies, omissions, or errors. You are responsible for reviewing, validating, and editing all content before sharing it with your students. Alquie does not guarantee the accuracy of generated content.

Usage limits

These generations are subject to daily and monthly usage limits per feature. The current limits and your real usage are published inside the platform at Settings → AI Usage, and the plan caps are also available on the public Plan limits page. When you reach the daily limit, the feature becomes available again at 00:00 (user time). When you reach the monthly limit, on the first day of the following month. These limits may be adjusted with 30 days' prior notice for active subscriptions.

6 Acceptable use

By using Alquie, you agree NOT to:

  • Use the platform for purposes other than teaching and educational learning.
  • Upload content that is illegal, inappropriate for minors, violent, discriminatory, or that infringes third-party rights.
  • Attempt to access other teachers' or students' data without authorization.
  • Reverse-engineer, decompile, or attempt to extract the platform's source code.
  • Use bots or automated scripts to access the platform in an unauthorized manner.
  • Sell, sublicense, or resell access to Alquie without our express authorization.

Violation of these conditions may result in the suspension or permanent deletion of your account, without right to a refund.

Initiating a fraudulent chargeback, or one filed without first attempting to resolve the issue with us, may result in the suspension of your account. If you have a problem with a charge, email us at billing@alquie.com and we'll resolve it.

7 Cancellation & what happens to your data

Voluntary cancellation

You can cancel your account at any time from your profile settings or by emailing hello@alquie.com. After cancellation:

  • Your access to the platform ends at the close of the current billing period.
  • You have 30 days to export your content and data.
  • After 90 days from cancellation, your account and all associated data (including student data) are permanently deleted.

If you are the owner of a course with an active paid subscription, you must cancel the subscription before deleting your account. If the course has collaborators, deleting your account as owner deletes the course and its data; transfer ownership beforehand if you want the course to continue.

Student data deletion

You can delete any student's data at any time from the student management panel. The data is removed from the active database immediately (the student can no longer log in and the data stops being displayed and processed). For technical continuity reasons, a copy may persist in encrypted backups for a short period (currently up to 7 days), after which it is overwritten in the routine backup rotation. An audit log entry is generated that you can download as proof of deletion.

Cancellation for breach

We reserve the right to suspend or cancel accounts that violate these terms, with or without prior notice depending on the severity of the violation.

8 Limitation of liability

Alquie is provided "as is" and we make our best effort to keep the platform available and functional. However:

  • We do not guarantee uninterrupted service availability.
  • We are not liable for data loss caused by events outside our reasonable control.
  • We are not responsible for content that teachers upload to the platform.
  • Our maximum liability for any claim shall not exceed the amount paid by the user in the preceding 12 months.

These limitations do not apply in cases of fraud or gross negligence on our part, or where applicable law does not permit such limitations.

9 Modifications to these terms

We may update these terms when necessary — for example, to reflect platform changes, new features, or regulatory changes.

For significant changes, we'll notify you at least 30 days in advance by email and with a prominent notice in the platform. Continued use of Alquie after the new terms take effect constitutes your acceptance of them.

If you disagree with changes, you may cancel your account before they take effect.

10 Governing law & disputes

These terms are governed by the laws of the Republic of Chile. Any dispute that cannot be resolved amicably shall be submitted to the ordinary courts of justice in the city of Santiago, Chile.

For users in the European Union: nothing in these terms limits the rights granted to you by European data protection and consumer laws.

For users in the United States: to the extent required by local law, rights under COPPA, FERPA, or other applicable state laws take precedence over these provisions.
